2. Scope

These Terms and Conditions govern your use of the VibinMind mobile application, related backend services, AI translation functions, camera translation, voice translation, live conversation translation, phrasebook features, and premium subscriptions.

3. Service description

VibinMind provides AI-assisted translation and language tools. The app may translate typed text, transcribe recorded speech, translate speech turns, extract readable text from images for translation, generate speech audio, and provide predefined offline phrases.

4. Account

To use premium features, you must create an account or sign in through a supported authentication provider. You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account unless caused by our breach of duty.

If you create an account, you can request account deletion in the app settings or through the account deletion page. Deleting your VibinMind account does not automatically cancel subscriptions managed by Apple App Store or Google Play.

5. Subscriptions, trials, and payments

VibinMind is a premium service. Available plans may include weekly, monthly, and yearly auto-renewing subscriptions. A free trial or introductory offer may be offered for selected plans only where shown in the app and confirmed by the relevant app store before purchase.

Subscriptions are purchased through the Apple App Store or Google Play. The store shown during purchase is your contractual payment interface for billing, renewal, cancellation, refunds, taxes, and payment method management. Prices, trial availability, renewal terms, and cancellation options are displayed by the relevant app store before purchase.

Subscriptions renew automatically unless cancelled in your Apple App Store or Google Play account settings within the deadline stated by the relevant store. Your account may be charged for renewal within the period specified by the store before the current billing period ends. You can manage or cancel subscriptions in your Apple App Store or Google Play account settings. Deleting the app or deleting your VibinMind account does not cancel a subscription.

Store prices, taxes, currencies, trials, billing periods, and introductory offers may vary by country, platform, and store account. If the app display and the store purchase sheet differ, the store purchase sheet controls the transaction.

6. Right of withdrawal and digital content

If you are a consumer in the European Union, you may have a statutory right of withdrawal for distance contracts. For digital content or digital services, this right may expire early where the law permits and where performance begins with the required consent and acknowledgement. In-app purchase cancellation and refund handling may be administered by Apple or Google under their applicable store rules.

7. Acceptable use

You must not use VibinMind to:

violate applicable law or third-party rights;
submit content you are not allowed to process or transmit;
generate, translate, or distribute unlawful, harmful, harassing, defamatory, discriminatory, sexual exploitation, child sexual abuse, extremist, or violent content;
reverse engineer, overload, scrape, interfere with, or bypass the app, subscription checks, APIs, security controls, or payment systems;
use the service to create malware, phishing, spam, fraud, impersonation, or deceptive activity;
resell, sublicense, or commercially exploit the service without permission.

8. AI output and translation accuracy

VibinMind uses AI systems and third-party services. Translations, transcriptions, image text extraction, and generated audio may be incomplete, inaccurate, inappropriate, or contextually wrong. You are responsible for reviewing output before using it. Do not rely on VibinMind as your sole source for medical, legal, financial, safety-critical, immigration, employment, official, or emergency decisions.

VibinMind is not a certified interpreter, legal translator, medical translator, emergency service, or official document translation service.

9. User content

You retain your rights to content you submit. You grant us the rights necessary to process your content to provide the requested service, including transmitting it to service providers for transcription, translation, image processing, text-to-speech, security, and abuse prevention. You confirm that you have the necessary rights and permissions to submit the content.

You should not submit content that is illegal, infringes third-party rights, contains confidential information you are not allowed to transmit, or exposes another person without the required permission.

10. Availability and changes

We aim to provide a reliable service, but VibinMind may be unavailable, interrupted, delayed, or changed due to maintenance, updates, network issues, app-store issues, provider outages, abuse prevention, legal requirements, or circumstances outside our control. We may modify, suspend, or discontinue features where reasonably necessary.

11. Third-party services

VibinMind depends on third-party services such as Supabase, OpenAI, RevenueCat, Apple App Store, Google Play, Google Sign-In, and Apple Sign-In. Their own terms and policies may apply to your interaction with those services.

12. Intellectual property

The app, design, code, brand, texts, phrasebook structure, and related materials are protected by intellectual property laws. Except for rights expressly granted to you, all rights remain with us or our licensors. You may use VibinMind only for its intended purpose and in accordance with these Terms.

13. Termination

You may stop using VibinMind at any time. You may delete the app and, where available, request account deletion in the app settings or by contacting us. Subscription cancellation must be completed through the Apple App Store or Google Play. We may suspend or terminate access if you materially breach these Terms, misuse the service, create security risk, fail to comply with applicable law, or where suspension or termination is required by law or platform rules.

14. Liability

Nothing in these Terms limits liability for intent, gross negligence, injury to life, body, or health, mandatory statutory liability, or rights that cannot legally be excluded. For slight negligence, we are liable only for breach of essential contractual obligations, limited to typical foreseeable damage. Essential contractual obligations are obligations whose fulfilment enables proper use of the service and on which users may regularly rely.

15. Consumer dispute resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless legally required.

The European Commission's Online Dispute Resolution platform was discontinued on 20 July 2025. Therefore, these Terms do not provide an ODR platform link.

16. Governing law

German law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection laws of your country of habitual residence remain unaffected.

17. Changes to these Terms

We may update these Terms where necessary due to feature changes, legal requirements, provider changes, security reasons, or business changes. The current version is shown by its version date. Continued use after an effective update may require acceptance of the updated Terms.
